En relación con las rentas de una persona domiciliada en el Perú obtenidas en un país extranjero miembro de la Comunidad Andina de Naciones (CAN), se consulta si la exoneración del impuesto a la renta, a que se refiere el artículo 3 de la Decisión 578 de la CAN, está condicionada a que se verifique un supuesto de doble tributación entendido como identidad de los sujetos, naturaleza y objeto del impuesto y período tributario.

Después del análisis correspondiente, se concluye en el informe:

En relación con las rentas de una persona domiciliada en el Perú obtenidas en un país extranjero miembro de la CAN, se tiene que la exoneración del impuesto a la renta, a que se refiere el artículo 3 de la Decisión 578, está condicionada a que se verifique un supuesto de doble tributación entendido como identidad de los sujetos, naturaleza y objeto del impuesto y período tributario.

La dirección general de desarrollo ganadero considerando que no se ha exportado alpacas desde el 2013 y llamas desde el 2005, propone fijar para el año 2023, la cuota de exportación de alpacas en 500 (quinientos) ejemplares como máximo; y, de llamas en 200 (doscientos) ejemplares como máximo, para su aprobación.

Mediante el presente decreto, se pone en ejecución a partir del 2 de agosto de 2023, la Decisión Nº 15 “Actualización del Anexo 4.2 (Requisitos Específicos de Origen) al Sistema Armonizado 2022”, adoptada por la Comisión de Libre Comercio del Protocolo Adicional al Acuerdo Marco de la Alianza del Pacífico el 24 de noviembre de 2022.

Se publica en el Diario Oficial “El Peruano” el texto íntegro de la Decisión Nº 15 a la que se refiere el artículo 1 del presente Decreto Supremo, el mismo que se encuentra publicado en la página web de Acuerdos Comerciales del Perú del Ministerio de Comercio Exterior y Turismo (www.acuerdoscomerciales.gob.pe).
